He had to have had one, if he had a real estate agency sell his house.


As long as the neighbor will back you up as saying he knew it.
If the guy knew it, (neighbor witness) and it's not in that disclosure,
You got him.

But, I'd let your agent handle it for starters, you paid them to be YOUR agent!
They are suppose to be looking out (WORKING) for YOU!!!!!
You can bet they got their commission percentage from the sale.

Anyways my 2cents.... as others have said talk to your agent first and go from there. I would contact a lawyer too, maybe the lawyer you had involved in the purchase of the house? See what they say. I also agree if the fees to fight are more than the amount taken I wouldnt bother. Also remember time is money as are the headaches and lost sleep involved in the fight so weigh all that in to the cost.

Dont forget to figure your time to go out and replace the fixtures and your time to paint and fix the problem spots. Some lawyers will do it contingent on what you gain in the suit. But most states states that if it was in the house when the sale was agreed to it should be in the house when you move in, unless specified in the sales agreement and agreed to in a that document. Hang him out, make him pay for trying to screw you over. People like this need to be taught a lesson. If nothing else call the cops and swear out a theft warrant for his a$$, That will get the point across. Good luck with whatever you do.

well I know our real estate agent said that we should make sure we dont get the keys until ALL of the stuff is moved out and we get to check out the place before signing. So we did .

I'm not going to pursue it legally, it would be just too much headache and I have enough BS to shovel through already. I'm just mystified that people do this.

I just have to remind myself that I bought the house for 2/3 of what they paid to build it 7 years ago (not counting landscape, deck and other add-ons) and that makes things better.

really though.. if you saved potentially 25K or more.. then replacing "Chattels" and doing some "landscaping" is the least of your concerns..

You should be spending your time counting all the beans you still have and planting a new LAN PARTY room in the basement as our previous home has to take a Hiatus
